Please read these Terms of Service carefully before using Ethereal Stories. By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
Ethereal Stories ("the Service", "we", "us", "our") is a digital card and memory platform that allows registered users to create, customise, and share digital story cards for personal occasions such as birthdays, anniversaries, weddings, and more. The Service is available at etherealstories.com.
You must be at least 16 years old to create an account. You agree to provide a valid email address and to keep your account credentials confidential. You are solely responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.
You retain full ownership of all photos, text, and other content you upload to the Service ("User Content"). By uploading User Content you grant Ethereal Stories a limited, non-exclusive, royalty-free licence to store, process, and display it solely for the purpose of delivering the Service to you. We do not claim ownership of your content, and we do not use it for advertising, machine learning, or any other purpose.
Publishing a story on Ethereal Stories requires a one-time payment. Prices are displayed at checkout in the currency shown and include applicable taxes where required by law. Payments are processed securely by Stripe. We reserve the right to change pricing at any time; any change will not affect stories already paid for. Promotional codes and discounts may be applied at checkout and are subject to their own terms and availability.
All payments made on Ethereal Stories are final and strictly non-refundable. Once a payment has been completed and your story has been published, no refund will be issued under any circumstances — including but not limited to accidental purchase, unused story credits, early deletion of a story by the user, technical issues not caused by us, or dissatisfaction with the output. By completing a payment you explicitly acknowledge and accept this no-refund policy. If you have a concern about a payment, contact us at the address below and we will review it in good faith, though we cannot guarantee a refund.
Published stories remain accessible for a limited period indicated at the time of creation, typically 7 days. After expiry, stories and all associated media are permanently and automatically deleted from our systems. Ethereal Stories is not responsible for any content lost after expiry. We do not offer manual extensions beyond the published expiry date. You may delete your story at any time before expiry; no refund will be issued.
If you enable the RSVP feature, guest information — including name, attendance status, message, and optionally email — is collected on your behalf. As the story creator you are the data controller for this guest data. You are responsible for informing guests that their responses are recorded and for complying with all applicable data protection laws. Guest data is permanently deleted when the story expires or is deleted.
You agree not to use the Service to upload, create, or share content that: infringes any third-party intellectual property or privacy rights; is unlawful, defamatory, abusive, threatening, or harassing; contains malware, harmful code, or phishing material; impersonates any person or entity; or violates any applicable law or regulation. We reserve the right to remove content and suspend accounts that violate these rules.
The Ethereal Stories name, logo, templates, platform design, and all related intellectual property are the exclusive property of Ethereal Stories. You may not copy, reproduce, modify, or distribute any part of the platform or its templates without our prior written consent.
The Service is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses. We are not responsible for loss of content resulting from technical failure, expiry, or user error.
To the maximum extent permitted by applicable law, Ethereal Stories' total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid for the specific story that is the subject of the claim. We shall not be liable for any indirect, incidental, special, or consequential damages.
We reserve the right to suspend or terminate your account at any time and without prior notice if you breach these Terms or if we believe your use poses a risk to the Service or other users. Upon termination, your stories and associated content will be deleted and payments already made will not be refunded.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a prominent notice on the Service. The updated Terms will indicate the date they became effective. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the European Union and the jurisdiction in which Ethereal Stories operates. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
